How Does Divorce Mediation Work?

Typically, a mediator meets with both parties to a divorce in order to identify common ground and focus on issues of particular importance to both. Issues such as child custody, visitation arrangements, division of marital property and the division of marital debt are handled through the mediator who is responsible for clarifying legal issues without giving legal advice.

In working toward a settlement, a mediator goes back and forth between the two parties involved, presenting proposed terms and changes to them until an agreement is reached. As your lawyer, I review proposed terms to ensure your legal and financial interests are protected.

What Are The Advantages Of Mediation?


Mediation puts both spouses in charge of their fate by allowing them to work toward and discover mutually agreeable divorce terms. While subject to final approval by the court, couples can negotiate who gets to keep the house, whether pension funds are to be excluded from the division of marital property, who gets custody of any children and how visitation will be structured. In this sense, mediation avoids having a judge impose terms that neither you nor your ex-spouse finds satisfactory.
