Your Voice Matters, Even When You Can't Speak for Yourself

Is a Living Will Legally Binding in Massachusetts?

Unlike a Health Care Proxy, Living Wills are not legally binding in Massachusetts. However, they are widely respected by physicians, hospitals, and family members as an important expression of your wishes.

For that reason, I recommend including a Living Will as part of a comprehensive estate plan. When combined with a Health Care Proxy, it provides meaningful guidance to the person you have chosen to make medical decisions on your behalf.
